PLEASE READ THESE TERMS CAREFULLY. By registering for an account or by accessing or using the BHAVRAH website, mobile application, or other online services (collectively, the "Services"), you agree to be bound by these Terms of Use (these "Terms") and any policies, guidelines or rules referenced herein (including the Privacy Policy, Community Guidelines, Cancellation & Refund Policy, and Grievance Redressal Policy). If you do not agree to these Terms, please do not use the Services.

1. PARTIES, SCOPE AND DEFINITIONS

1.1 Parties: These Terms are between you ("you", "your" or "User") and Bhavrah ("Bhavrah", "we", "us" or "our").

1.2 Scope:

Bhavrah operates a digital platform (mobile and web) that connects travellers and local users (including hosts, guides and micro-entrepreneurs) to communicate, share content and list or book services such as accommodation, meals, local experiences and transport. Bhavrah provides the technical infrastructure (search, profiles, messaging, booking, payment processing, ratings, and related services) that enables user-to-user interactions.

Bhavrah is initially launched in India and may be used globally. Where the Services are accessed from jurisdictions outside India, additional terms, operational features, local laws or regulatory requirements may apply. To the extent mandatory consumer protections or local regulations in a user’s jurisdiction conflict with these Terms, those mandatory protections will take precedence.

1.3 Role as Intermediary:

Except where expressly stated otherwise, Bhavrah is a technology intermediary and marketplace that facilitates connections and transactions between Users. Bhavrah is not the provider of offline services offered by Users (such as accommodation, food, transport or guide services) unless Bhavrah expressly states otherwise in writing. Bhavrah’s role is to provide the platform and tools to enable user-to-user transactions; the actual provision, safety, quality and legality of offline services remain the responsibility of the Service Providers and Users who accept or arrange them.

1.4 Definitions:
  • "User Content" means material you post or make available through the Services (profiles, photos, messages, listings, reviews, ratings, comments and other content).
  • "Service Provider" or “Host” means a User who lists or offers services (for example accommodation, tours, meals, transport, rentals) through the Services.

2. ELIGIBILITY, REGISTRATION & ACCOUNTS

  • 2.1 Age and eligibility: You must be at least 18 years old to register. Minors may use the Services only with parental or guardian consent and in compliance with applicable law.
  • 2.2 Accurate information: You agree to provide true, accurate and up-to-date information when registering and to keep your account information current. Bhavrah may require identity verification (KYC) for certain transactions; refusal to comply may limit account functionality.
  • 2.3 Account security: You are responsible for activity under your account. Notify Bhavrah immediately of any unauthorised use. Bhavrah is not liable for losses resulting from compromised credentials in the technology era.

3. INDEPENDENT TRANSACTIONS, BHAVRAH'S ROLE & ASSUMPTION OF RISK

3.1 Bhavrah’s role, why users rely on the platform, and allocation of responsibility

Bhavrah provides a trusted, easy-to-use marketplace that brings together travellers and local hosts, guides and micro-entrepreneurs — offering discovery, communications, secure payment tools, reputational signals (ratings and reviews), and operational supports such as booking confirmations, optional escrow/hold features, identity verification, in-app messaging, and a local grievance & complaints channel. These features are intended to reduce friction, improve transparency and help Users make informed choices.

However, except as explicitly set out in these Terms or in specific product descriptions, Bhavrah does not directly provide the offline goods or services listed by Service Providers, and does not control the day-to-day performance of those services. Users therefore choose to use the Services because Bhavrah: (a) makes it easier to find and compare local offerings; (b) provides tools (profiles, reviews, verification, secure payments) that assist decision-making; and (c) offers support channels (help centre, dispute assistance, Grievance Officer) to raise and resolve concerns. These platform features are supportive measures — they are not guarantees that every transaction will meet expectations.

Accordingly, while Bhavrah takes reasonable steps to operate and maintain the Services and to provide safety-related features and policies, Bhavrah is not responsible for the conduct of Service Providers or other Users, nor for the adequacy, safety, legality or fitness of any offline service provided via the platform, except where applicable law requires platform accountability. Users must exercise their own judgment, perform due diligence (for example review profiles and ratings, verify identity and credentials where relevant, and follow Safety Guidance), and follow local health and safety rules when accepting or using third-party services.

Bhavrah may from time to time offer additional protections or facilitation services (for example, facilitation of refunds, escrow or hold services, optional insurance products offered by third parties, or verified-provider programs). Any such offering will be described in product terms and will be subject to separate conditions; the availability of such services does not convert Bhavrah into the offline provider of the underlying service.

3.2 Assumption of risk:

Use of the Services may involve inherent risks (personal safety, health, hygiene, theft, damage). Users assume these risks when interacting with other Users, attending events, booking accommodation, accepting food or using transport arranged through the Services. Bhavrah strongly recommends independent checks (ID verification, reviews, references) and protective steps described in our Safety Guidance.

4. ACCEPTABLE USE & PROHIBITED CONDUCT

We ask all users to treat others with respect and to take simple, sensible precautions when interacting through Bhavrah. Before you book or meet, please review profiles and ratings and—when available—use Bhavrah’s verification tools; prefer public, well‑lit places for first in‑person meetings and use the in‑app secure payment options rather than sharing OTPs, passwords or bank details. Hosts and service providers should give accurate descriptions, disclose any known safety or access considerations, and follow applicable laws. If anything feels unsafe or goes wrong, please use the in‑app reporting tools so our team can respond quickly. These easy steps help keep Bhavrah welcoming and comfortable for everyone.

  • 4.1 Compliance: You must comply with all applicable laws and these Terms.
  • 4.2 Prohibited uses: You must not use the Services to post or distribute content or perform acts that: (a) are unlawful, fraudulent, obscene or defamatory; (b) promote discrimination, hatred or violence; (c) violate intellectual property or privacy rights; (d) transmit malware or attempt to impair Services; (e) misrepresent identity, qualifications or credentials; or (f) facilitate unlicensed regulated activities (for example regulated medical practice, commercial transportation without license where required).
  • 4.3 Enforcement: Bhavrah may remove, restrict access to or modify User Content, suspend or terminate accounts, and report unlawful conduct to authorities. Bhavrah retains discretion to act immediately when required to protect users or the platform.

5. LISTINGS, BOOKINGS & PAYMENTS

  • 5.1 Service listings: Service Providers are responsible for the accuracy of their listings (descriptions, pricing, availability, photos, safety disclosures, permit or license status). Bhavrah may require evidence of eligibility for certain categories (for example business license, certifications).
  • 5.2 Booking & payment processing: Payments are processed via third-party payment processors and/or app stores. Bhavrah may act as facilitator or processor depending on integration; payment settlement timelines, fees, and refund mechanics will be disclosed at checkout and governed by our Payments Policy. For global transactions, pricing and settlement may occur in different currencies and Users are responsible for conversion fees where applicable.
  • 5.3 Escrow & dispute holds: If Bhavrah offers escrow or hold-and-release mechanisms, release conditions will be set out in booking confirmations. Bhavrah may temporarily withhold payouts when investigating disputes, suspected fraud, or serious safety complaints.
  • 5.4 Fees & taxes: Users are responsible for all applicable taxes, duties and levies. Bhavrah may collect applicable taxes and may require service providers to provide tax information where required by law.

6. RATINGS, REVIEWS & REPUTATION SYSTEMS

  • 6.1 User feedback: Reviews, ratings and reputational signals are user-generated and reflect other users’ views. Bhavrah may moderate or remove content that violates policy.
  • 6.2 Accuracy & misuse: Posting misleading, fraudulent, false or defamatory feedback is prohibited. Bhavrah may investigate and remove suspect reviews and take action against repeat abusers.

7. INTERMEDIARY COMPLIANCE, GRIEVANCE REDRESSAL & NOTICE PROCEDURES

  • 7.1 Compliance with Intermediary Rules: Bhavrah will implement due-diligence measures and grievance redressal mechanisms required of intermediaries under applicable law, including maintaining clear rules, a published privacy policy and grievance officer contact details.
  • 7.2 Grievance Officer: Bhavrah has appointed a Grievance Officer in India. The Grievance Officer contact details are published below. The Grievance Officer will acknowledge complaints within 48 hours and endeavour to address grievances within timelines prescribed by applicable rules.
  • 7.3 Notice and takedown: Bhavrah will follow a notice-and-takedown procedure for allegedly unlawful content and will respond to valid notices in accordance with applicable law. Users must use the designated contact channels to submit complaints.

8. PRIVACY & DATA PROTECTION

  • 8.1 Privacy Policy: Bhavrah’s handling of personal data is governed by the Privacy Policy, which forms part of these Terms. By using the Services you consent to the collection and processing described therein.
  • 8.2 Cross-border data transfers: Because Bhavrah operates globally and uses cloud services, personal data may be transferred to, stored and processed in countries other than your country of residence. Bhavrah will take reasonable safeguards to protect personal data during transfer and processing in accordance with applicable law.
  • 8.3 Applicable law: Bhavrah will comply with applicable personal data laws and will take reasonable steps to protect personal data. Users should review the Privacy Policy for data subject rights and contact procedures.

9. CONSUMER PROTECTION

  • 9.1 Consumer rights preserved: Nothing in these Terms limits statutory consumer rights under the Consumer Protection Act, 2019 (India) or other applicable consumer protection laws in your jurisdiction.
  • 9.2 Marketplace liability: Where law or regulatory guidance holds platforms responsible for certain aspects of user complaints or product/service safety, Bhavrah will comply and cooperate with regulators and consumer authorities.

10. DISCLAIMERS, WARRANTIES & LIMITATION OF LIABILITY

10.1 No warranty: THE SERVICES AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE". BHAVRAH DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY OF INFORMATION, TITLE, OR NON-INFRINGEMENT, TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW.

10.2 Exclusion for offline services: BHAVRAH IS NOT A SERVICE PROVIDER, HOST, EMPLOYER OR AGENT OF ANY USER. BHAVRAH DOES NOT CONTROL SERVICE PROVIDERS OR GUARANTEE SERVICE QUALITY, SAFETY, LEGALITY OR FITNESS. BHAVRAH DISCLAIMS LIABILITY FOR PERSONAL INJURY, PROPERTY DAMAGE, ILLNESS, THEFT OR OTHER LOSSES ARISING FROM USER-TO-USER INTERACTIONS OR THIRD-PARTY SERVICES ARRANGED THROUGH THE PLATFORM, TO THE MAXIMUM EXTENT PERMITTED BY LAW.

10.3 Service protections and limits: Bhavrah may provide protective or facilitative services (identity verification, escrow mechanisms, optional third-party insurance offers, curated or verified-provider programs, or dispute support). These features do not convert Bhavrah into the direct provider of the underlying offline service nor create liability beyond what is expressly promised in those product terms.

10.4 Limitation of liability: TO THE MAXIMUM EXTENT PERMITTED BY LAW, BHAVRAH’S AGGREGATE LIABILITY FOR DIRECT DAMAGES ARISING OUT OF OR RELATED TO THESE TERMS SHALL BE LIMITED TO THE GREATER OF (A) THE TOTAL AMOUNTS PAID BY YOU TO BHAVRAH IN THE SIX (6) MONTHS PRECEDING THE CLAIM, OR (B) INR 20,000 (TWENTY THOUSAND RUPEES) OR AN EQUIVALENT AMOUNT IN LOCAL CURRENCY FOR USERS LOCATED OUTSIDE INDIA.

10.5 Indirect damages excluded: BHAVRAH SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, PUNITIVE OR SPECIAL DAMAGES (INCLUDING LOSS OF PROFITS OR REVENUE), EVEN IF BHAVRAH HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, TO THE EXTENT PERMITTED BY LAW.

10.6 Indemnity: You agree to indemnify Bhavrah, its officers, directors, employees and agents against losses, liabilities and expenses (including reasonable legal fees) arising from your breach of these Terms, your wrongful acts or omissions, your User Content, or your interactions with other users.

11. TERMINATION & SUSPENSION

  • 11.1 Suspension: Bhavrah may suspend or restrict accounts, listings or functionality in case of policy violations, suspected fraud, safety concerns, legal process, or to protect users or the platform.
  • 11.2 Termination: Bhavrah reserves the right to terminate accounts for repeated violations or for material breach or for favor of Bhavrah ‘s interest of growth or for damage control.
  • 11.3 Effect: Termination does not relieve parties of obligations incurred prior to termination (for example payment or indemnity obligations). Certain sections survive termination.

12. INTELLECTUAL PROPERTY

  • 12.1 Bhavrah IP: All software, designs, content, logos and trademarks are owned or licensed by Bhavrah.
  • 12.2 User Content license: By posting User Content you grant Bhavrah a worldwide, non-exclusive, royalty-free, transferable and sublicensable license to use, reproduce, adapt, publish and display such content for operating, improving, promoting and marketing the Services, subject to privacy settings and applicable law.

13. DISPUTE RESOLUTION, GOVERNING LAW & JURISDICTION

  • 13.1 Governing law: These Terms are governed by the laws of India, except where mandatory local laws applicable to Users in other jurisdictions require a different governing law or forum for consumer disputes.
  • 13.2 Jurisdiction: Subject to applicable law and your local consumer protections, courts in Chandigarh, India shall have exclusive jurisdiction to adjudicate disputes arising from these Terms.
  • 13.3 Alternative dispute resolution: Bhavrah may, at its discretion, offer mediation, conciliation or internal dispute resolution mechanisms prior to formal litigation.

14. CHANGES TO THE TERMS

Bhavrah may update these Terms. Where changes are material, we will give notice and publish the revised Terms with an updated "Last updated" date.

16. MISCELLANEOUS

  • 16.1 Assignment: You may not assign rights or obligations without Bhavrah’s prior written consent. Bhavrah may assign these Terms to a successor or legal representative or team member.
  • 16.2 Severability: If any provision is invalid or unenforceable, the remaining provisions remain in force.
  • 16.3 Entire agreement: These Terms and referenced policies constitute the entire agreement.

ANNEX A — NOTICE & TAKEDOWN / COPYRIGHT POLICY

Procedure for reporting alleged infringement:

  • Send written notice to the Grievance Officer with identification of work, location of material, contact details, good-faith statement, and authorisation statement.
  • Bhavrah will acknowledge, investigate and—where appropriate—remove content in accordance with applicable law.

SAFETY GUIDANCE

  • Prefer public meeting places for first interactions; inform someone of your plans.
  • Verify identity badges, read reviews and use in-app messaging until comfortable.
  • Discuss allergies, hygiene and expectations before accepting food or accommodation.
  • Report safety incidents immediately via in-app tools and contact local authorities as needed.

ACKNOWLEDGEMENT

By using Bhavrah you acknowledge that you have read, understood and accepted these Terms of Use and agree to be bound by them.
